二 | 正因如此，有人看上了这里丰富的物种，殊不知早已踩了红线。近日，杭州市临安区人民法院审结一起非法采挖国家重点保护野生植物案件。据了解，被告人刘某和赵某（均为化名）原计划上山采挖老鸦柿做成盆景售卖。两人一路开车，从临安城区往清凉峰镇石长城村方向驶去，车里还放着编织袋和铁铲。到山脚后，两人停车，背起工具徒步进入天目山—清凉峰生物圈保护区。山里的植被茂密，灌木丛中偶尔冒出几株形态特别的植物。赵某先发现了第一株。这株植物轮生的七片叶子托着一朵花，像一把撑开的伞，在山风中轻轻摇曳。“七叶一枝花。”刘某认出来了。二人对视一眼，心里都清楚，这东西不一般。

三 | 七叶一枝花，学名重楼，国家重点保护野生植物，在民间被称为“蛇药王”，也是云南白药的重要成分。无论是采挖、运输，还是出售、收购，每一样都踩在法律红线上。

四 | “我们经常上山，这个药很有效果。

五 | 反正山这么大，没人看见。”赵某抱着侥幸心理，弯下腰，徒手扒开泥土，将它连根拔起，一株、两株、三株……两人越挖越顺手，从山脚到半坡，一路挖了18株七叶一枝花。两人下山后，被当地村民发现，并报警。

六 | 经鉴定，这18株七叶一枝花未造成实际损毁，最后被种回了保护区。临安区法院审理认为，两名被告人违反国家规定，非法采挖国家重点保护植物，情节严重，行为已构成危害国家重点保护植物罪，最终判处二人有期徒刑并处罚金。不少人以为山上的野生植物可以随意采挖，这是非常错误的想法。案件承办法官提醒大家：根据《中华人民共和国自然保护区条例》相关规定，禁止在自然保护区内进行砍伐、放牧、狩猎、捕捞、采药、开垦、烧荒、开矿、采石、挖沙等活动。
